“Coffee Party” Founder Is Obama Campaign Operative

Friday, March 5th, 2010

Billed as an alternative grassroots movement to the Tea Party, which has been for the most part absorbed by mainline Republicans and Neoconservatives, the “Coffee Party” promised to wake up politically minded Americans and offered a different avenue for the freedom movement.

However, the so called founder of the Coffee Party has been quickly exposed as an Obama campaign operative, whose caffeine concept was purely designed to undermine and co-opt the Tea Party ideology.

Described as “a documentary filmmaker who lives outside Washington”, Annabel Park has amassed some 40,000 members via a Facebook page.

“We’re not the opposite of the Tea Party,” Ms. Park, 41, told the New York Times. “We’re a different model of civic participation, but in the end we may want some of the same things.”

“We need to roll up our sleeves, put our heads together and work it out,” she said. “That’s, to me, an American way of doing this.”

The slogan is “Wake Up and Stand Up.” The mission statement declares that the federal government is “not the enemy of the people, but the expression of our collective will, and that we must participate in the democratic process in order to address the challenges we face as Americans.”

At first glance this sounds like attractive stuff to concerned Americans who are sick and tired of big government ruling over their lives. However, a quick background search on Miss Park reveals her real intentions.

Park campaigned for Obama in 2008 and was one of the organizers and operators of the influentialUnited for Obama video channel at YouTube.

“I found that people have little understanding of the change that Senator Barack Obama is advocating. I thought from my experience in using videos for civil movements that videos would be the best way to promote the need for change and for Obama. That’s why I decided to work for the Obama campaign,” Annabel Park said.

She made over twenty promotional videos for the Obama campaign that drew tens of thousands of views.

William A. Jacobson of Le-gal In-sur-rec-tion has the full story.

The revelation, along with the discovery that Park is a former Strategy Analyst at the NY Times, [Park's Linked In page has been taken down, here is a cached link] explains why she has received a great deal of mainstream media coverage recently.

The Times and the Washington Post both ran glowing articles on Park in the last week, a factor that immediately raised suspicion over her grassroots credentials.

Clearly, either the newspapers were incapable of googling her name or taking five minutes to look into her activities, or they were fully aware of Park’s intentions and background and chose not to include it in their pieces.

In addition, Park’s various tweets reveal that, far from being open to working with Tea Party activists, Park appears to have a vitriolic hatred of them:

“The Coffee Party simply is part of the perpetual Obama campaign, a means by which to subvert the real grassroots Tea Party movement by co-opting part of the message, but in a way which supports keeping Obama in power.” Jacobson writes.

“Much like a parasite which feeds off of and ultimately takes over the host.”

The author of the New York Times piece has since declined a request by Jacobson to update her article on Park with this information.

Unfortunately, the Coffee Party is simply another example of the entrenched political establishment piggy backing on the unstoppable grassroots liberty movement in an attempt to manipulate and control it.

MSNBC Continues Propaganda Campaign Against Patriot Groups

Wednesday, March 3rd, 2010

Anti-patriot propaganda has reached a fevered pitch in the corporate media. In the MSNBC segment below, Contessa Brewer interviews Mark Potok of the Southern Poverty Law Center. Brewer prefaces her interview with Potok — who is now a fixture of the ongoing propaganda campaign — by stating that opposition to the government is “fueled in part by anger over the troubled economy,” the fact Obama is African-American, and “immigration issues” (in other words, illegal aliens streaming across the border).

Visit msnbc.com for breaking news, world news, and news about the economy

Brewer’s subtext (undoubtedly written for her and read from a teleprompter) is that people upset with the government are a bunch of racists. Of course, if she was a real reporter instead of an info babe put before the camera because she is attractive and can read a teleprompter, she just might elaborate on this and say people are upset with the government because it is increasingly authoritarian and violates the Constitution and the Bill of Rights on multiple fronts — from Obamacare at gunpoint to illegal wars and the pervasive surveillance grid intruding upon our lives.
Dead-pan Potok is amazed at the “scope” of the growth of groups on the “radical right” (that is to say anybody who is not a Republican neocon or Democrat). Potok conflates the patriot movement with the “militias from the 1990s” (does he mean the government created militia at Elohim City, including the government agent Timothy McVeigh, or the militia operatives dispatched by the Southern Poverty Law Center and the FBI?). Potok says 363 new “radical right” groups have formed in the last year. Is it possible these new groups include those created by the Republican compromised Tea Party movement? Potok does not say.

Potok tells Ms. Brewer patriot groups see the federal government as their primary enemy and believe “the government is involved in all kinds of nefarious plots to bring us into the New World Order, so called and so on.”

So called by Henry KissingerGordon BrownBush Senior, and no shortage of economists and assorted establishment politicos over the last one hundred years or so. (and so on).

Patriot groups, Potok insists, are responsible for criminal violence. He then effortlessly connects Joe Stack to the patriot movement, but for some reason neglects to mention that Stack’s allegedmanifesto referenced communism, hardly considered a “radical right” philosophy.

In addition, Potok says the widely held belief that the income tax is unconstitutional has “raised a lot of havoc” (and so did strapping British tax collectors to Liberty Poles in the 1770s by American revolutionaries).

Ms. Brewer then says the attack on the IRS building in Austin was similar to the attack on the federal building in Oklahoma City. She may be right — evidence indicates the latter attack was staged by the government and it may eventually come out that Stack’s attack was too. Ms. Brewer would not report this in a month of Sundays, not if she values her career.

Potok concludes by stating his concern that “hate groups” (the ticker below him exclaims) may engage in violence, mostly because there is a black man in the White House and the “demographic change” in the country. He stops short of demanding anybody who believes in less government and adherence to the Constitution should be rounded up and thrown in a re-education camp.

It seems Potok and Brewer were reading from the Department of Homeland Security’s “rightwing” extremism report because their conversation came off like a carbon copy of the now infamous report (especially Potok’s assertion that patriot groups hate Obama because of his skin pigmentation).

It is indeed surreal that such nonsense about violence should be aired on a network that is jointly owned by a corporation founded by a eugenicist (Bill Gates, the former CEO of Microsoft) and the notorious death merchant General Electric (manufacturer of military aircraft, tankers, helicopters, surveillance aircraft and bombers used most recently to subdue recalcitrant Muslims).

I mean, talk about a hate group.

Baby girl survives after being shot in the chest in parents’ ‘global warming suicide pact’

Tuesday, March 2nd, 2010

A seven-month-old baby girl survived three days alone with a bullet in her chest beside the bodies of her parents and toddler brother.

Argentines Francisco Lotero, 56, and Miriam Coletti, 23, shot their children before killing themselves after making an apparent suicide pact over fears about global warming.

Their son Francisco, two, died instantly after being hit in the back.

But their unnamed daughter cheated death after the bullet from her dad’s handgun missed her vital organs.

Paramedics rushed her to hospital covered in blood when police alerted by worried neighbours discovered the massacre three days later.

The youngster is recovering in hospital in the town of Goya in the northern Argentine province of Corrientes, where doctors say she is out of danger.

Her parents said they feared the effects of global warming in a suicide note discovered by police.

75 reasons to be skeptical of “global warming”

75 reasons to be skeptical of “global warming”

Wednesday, February 24th, 2010

* Carbon dioxide contributes to only 4.2 – 8.4% of the greenhouse gas effect

* Only approximately 4% of carbon dioxide is man-made

* Water vapor accounts for 90 – 95% of the green house gas effect

* 99.99% of water vapor is natural, meaning that no amount of deindustrialization could get rid of it

* There have been many times when the temperature has been higher than it is now including the Medieval Warming Periodthe Holocenethe Jurassicand the Eemian

* Increases in carbon dioxide follow increases in temperature by about 800 years, not precede them

* Phil Jones of the Hadley CRU, and key figure in the “climategate” scandal, admits that there has been no “statistically significant” global warming since 1995

* 2008 and 2009 were the coolest two years of the decade

* During the Ordovician period carbon dioxide concentrations were twelve times what they are now, and the temperature was lower

* Solar activity is highly correlated with temperature change:

* Studies show that half of all recent warming was solar

* Mars has warmed about 0.5°C since the 1970’s, approximately the same that earth has warmed over the same period

* The 0.7°C increase in temperatures over the last century is entirely consistent with well-established, long-term, natural climate trends

* The distance between Earth and Sun changes every year, affecting the amount of energy the earth receives

* Earth’s tilt oscillates between 21.4° and 24.8°, which affects the distribution of the sun’s energy

* Dr. Roy Spencer has written that clouds have been a more important driver of climate than carbon dioxide since 2000

* Approximately 40% of the uncertainty in temperature projections come from uncertainty in the strength of the “feedback loop” between temperature and carbon dioxide. Recent research suggests the “feedback loop” is less than half as strong than many had presumed

* James Hansen of NASA said in a simulation of temperatures from 1880 to 2000 soot accounted for 25% of observed global warming

* Research suggests that soot could have nearly as much impact on climate change as carbon dioxide

* Antarctica has 90% of earth’s ice and it is growing

* Arctic sea ice has returned to 1979 levels, which is when records began

* The Arctic ice caps have recovered from their loss in 2007

* The Arctic is now 1°C cooler than it was in the 1940’s

* Polar bear populations are increasing

* Polar bears are able to swim over 60 miles continuously

* Sea level 81,000 years ago was 1 meter higher than it is now while carbon dioxide levels were lower

* A chart of sea level change over millions of years looks like this:

* According to satellite data, sea level has been decreasing since 2005

* Instead of hurting forests, the increased level of carbon dioxide has been helping them grow

* The official “record” for temperatures only goes back 150 years

* Although the IPCC may have 2500 members, only approximately 800 contribute to the scientific writing of the report

* Only 52 scientists contributed to the 2007 IPCC summary for policy makers, although diplomats from over 115 countries contributed

* Only 20% of the members of the IPCC deal with climate science

* Head of the IPCC, Dr. Rajendra Pachauri has no background in climate science. His PhD is in economics and he worked as a railway engineer before becoming head of the IPCC

* Former IPCC lead author Ben Santer openly admits that he altered portions of the 1995 IPCC report to make them “consistent with the other chapters”

* John Christy, former lead author on the 2001 IPCC report, speaks of his former co-lead authors deliberately trying to sensationalize the report

*Richard Lindzen, another lead author on the 2001 IPCC report, accused the IPCC of being “driven by politics”

* Michael Mann’s “hockey stick” graph, which was featured prominently in the 2001 IPCC report, was created using only portions of a data set. The red line is the graph of Mann’s selected data, while the black line is the graph of all the data:

* When asked to act as an expert reviewer on the IPCC’s last two reports, Dr. Nils Axel-Morner was “astonished to find that not one of their 22 contributing authors on sea levels was a sea level specialist”

* Until 2003, the IPCC’s satellite-based evidence showed no upward trend in sea level, so they used an increase of 2.3mm in one Hong Kong tide-gauge to adjust the entire global sea level up 2.3mm

* The IPCC’s claim that the Himalayan glaciers were melting was based off of a phone interview with a non-scientist. They were forced to retract the claim

* The IPCC claim that global warming was led to increased natural disasters was based on an unpublished report that had not been subject to peer-review. They were forced to retract the claim

* The IPCC’s claim that global warming was going to lead to deficiencies of up to 50% in African agriculture was based on a non-peer-reviewed and non-scientific paper. They were forced to retract the claim

* The IPCC’s claim that “up to 40% of the Amazonian forests could react drastically to even a slight reduction in precipitation” was based on a non-peer-reviewed and non-scientific paper. They were forced to retract the claim

* The IPCC reported that 55% of the Netherlands was below sea level when just 26% of the country is below sea level. They were later forced to retract the claim

* According to the United States Historical Climatology Network (USHNC,) 90% of US climate-monitoring surface stations have been found to be “poorly situated,” meaning that they have a margin of error greater than 1°C, more than the global warming in the entire 20th century. (The US surface data is generally considered the best surface data in the world):

* Many climate-monitoring surface stations are in locations that look like this:

* Temperature measurements from climate-monitoring surface stations are collected by hand. At one surface station in California, Anthony Watts found that only data from 14 out of 31 days had been completed in a month

* If a surface station is missing data for a particular day, data from surrounding surface stations is used to fill-in. Since 90% of all surface stations are poorly situated, even if a surface station itself is not poorly situated, if its data is missing for a day, there is a very good chance its temperature will be calculated using data from surface stations that are poorly situated

* In April 1978, there were 6,000 climate-monitoring surface stations. There are now about 1,200

* The vast majority of climate-monitoring stations that were lost were rural ones, which have been shown to give the most accurate data:

* The raw data is “adjusted” by a computer program. The net effect of this “adjustment” has been to increase the “adjusted” numbers over the “raw” numbers by .5°F, an increase that has been growing year by year:

* Difference between the USHCN “raw” data (in blue) and NASA “homogenized” data (in red):

* According to a leaked email in “climategate,” “temperatures in Darwin [a monitoring station in Australia] were falling at 0.7 Celsius per century […]but after the homogenization, they were warming at 1.2 Celsius per century. [...][W]hen those guys “adjust,” they don’t mess around.”

* According to a leaked email in “climategate,” computer programmer Harry Harris called the CRU data set “hopeless,” and said “the rest of the databases seem to be in nearly as poor a state as Australia was. [...]This whole project is SUCH A MESS. No wonder I needed therapy!!”

* When looking at source code leaked in “climategate” used to “process” and “adjust” temperatures, software engineer John Graham-Cumming said he found at least five errors and “wouldn’t trust it”

* The Hadley CRU, the institution at the center of the “climategate” scandal, threw out original temperature data because it claimed it did not have “storage space”

* In 1990, Dr. Phil Jones, the man at the center of the “climategate” scandal, contributed to a paper arguing that the effect of urban warming in eastern China was “negligible.” This became a key reference source for the IPCC. It turns out that 49 of the 84 climate-monitoring stations used for this report had no history of their locations or other details. This included 40 of the 42 rural stations. Of the rest, 18 had “certainly been moved” during the study period, including one that was moved five times over a total distance of 41 km. When Jones “re-examined” data in the same area for a 2008 paper, he found that urbanization was responsible for 40% of the warming found from 1951 to 2004

* Ross McKitrick and Patrick Michaels have argued that half of the global warming trend from 1980 to 2002 is caused by urban warming

* The Hadley CRU has been accused of using data from just 25% of Russia’s surface stations, deliberately overstating Russia’s warming by .64°C between the 1870’s and 1990’s

* According to emails leaked in “climategate,” when “Climate Research” published articles by global warming skeptics, Phil Jones and others urged scientists to “stop considering ‘Climate Research’ as a legitimate peer-reviewed journal”

* William Connolly, a Wikipedia administrator and co-founder of Realclimate.org, a website that supports the theory of anthropogenic global warming, “touched” over 5,400 Wikipedia articles, routinely omitting voices that were skeptical of global warming

* Large computer climate models are unable to even simulate major features of past climate such as the 100 thousand year cycles of ice ages that have dominated climate for the past 700 thousand years

* This is a picture of what Britain looked like in the summer of 2009 when its sophisticated climate “supercomputer” had predicted a “barbeque summer”:

* The US government spends over $2.5B funding climate research every year, and over $7B when grants for technology, tax breaks, and foreign aid are included (this is while Exxon gave $22M to global warming skeptics over a 10 year period)

* Many scientist assert that government grant money is given preferentially to advocates of man-made global warming

* Bart Chilton, a CFTC commissioner, said “carbon markets could be worth $2 trillion in transaction value – [...]within five years of trading (starting). [...]That would make it the largest physically traded commodity in the US, surpassing even oil”

* The owners of the trading floor where the carbon credits will be traded, including Goldman Sachs and Al Gore, stand to earn trillions if cap-and-trade is passed

* The cap-and-trade bill allows the government police powers to come into your home and inspect it for “energy efficiency,” and to fine you every day your home is not compliant

* Australian homes now have to undergo a mandatory energy-efficiency assessment – costing up to $1500 per property – before they can be sold or rented under new laws to tackle carbon emissions

* UN Secretary General Ban Ki-Moon has called for “global governance structure” to monitor greenhouse gases, which everyone on the planet emits with every exhale

* The United Nations forecasts that the global population will rise, peak and then decline between 2050 and 2300 to just under 9 billion

* Despite proclamations that there is a “consensus” and the debate is “settled,” 18% of scientists surveyed in the last poll trying to discern scientific opinion do not believe in man-made global warming

* 45% of Americans think global warming is man-made, down 9% from just half a year earlier

* In the court case Dimmock v Secretary of State for Education and Skills, a British judge ruled that there were nine “inaccuracies” in An Inconvenient Truth, including Gore’s claim that sea level could rise by up to 20 ft. The IPCC’s own report predicted a maximum rise of 59cm in sea level over 100 years. The Science and Public Policy Institute has taken issue with thirty five of Gore’s claims in An Inconvenient Truth

* Al Gore bought a $4M condo feet from ocean in Fisherman’s Wharf, San Fransisco, a city he had explicitly warned about in An Inconvenient Truth

Hmm, well, that’s suspicious, but I suppose that doesn’t matter if he tells us it’s alright.

Poll: Americans pretty clueless about politics, world

Saturday, January 30th, 2010

Only one in four Americans know how many votes a Senate filibuster requires. One in three know the name of the chairman of the Republican Party. One in two know the Democratic leader of the US Senate.

Health care? Fewer than one in three Americans even know that no Republicans voted for the Senate health care overhaul.

Americans’ ignorance about politics isn’t new, but the latest results from the Pew Poll suggest few are really paying attention.

Half of Americans don’t even know that Stephen Colbert is a comedian. And among those surveyed, only one in three Democrats knew that Sen. Harry Reid (D-NV) was the Democratic leader.

“About four-in-ten (39%) know that Nevada Democrat Harry Reid is the majority leader of the U.S. Senate,” Pew reports. “About a third (32%) correctly pick Michael Steele as the chairman of the Republican National Committee. Interestingly, nearly half of Republicans (48%) are able to identify Reid as Senate majority leader compared with just a third (33%) of Democrats. More Republicans can identify Reid as majority leader than can identify Steel as chairman of the RNC (37%).”

“About four-in-ten (41%) correctly say that Stephen Colbert is a comedian and television talk show host,” Pew adds.

Notably, those who are more clueless about politics hail from the under 30 age bracket — except for the question about Colbert.

“This is the only question on the quiz that more people younger than 30 than older people answer correctly (49% vs. 39%),” Pew notes.

586 2 Poll: Americans pretty clueless about politics, world

Adds Pew:

About six-in-ten (59%) correctly identify China as the foreign country holding the most U.S. government debt. Nearly as many (57%) know that the United States imports two-thirds of the oil it consumes. As was the case in previous knowledge surveys, a majority (55%) knows the current unemployment rate is about 10%. However, far fewer (36%) correctly estimate the current level of the Dow Jones Industrial Average at about 10,000 points.

The news quiz, conducted by the Pew Research Center for the People & the Press Jan. 14-17 among 1,003 adults reached on cell phones and landlines, asked 12 multiple choice questions on subjects ranging from economics and foreign affairs to prominent people in the news. Americans answered an average of 5.3 questions correctly.

The survey finds that while the public struggled with most of the political questions on the survey, most Americans (56%) know that there currently is more than one woman serving on the Supreme Court. Notably, this is the only question on the quiz where as many women as men answer correctly; men scored significantly better on other questions.

In response to questions about terrorism and national security, half (50%) correctly identify Yemen as the country where intelligence officials believe the suspect in an attempted Christmas Day airline bombing received training and bomb materials. A slightly smaller percentage (43%) knows that during all of 2009 there were more American military fatalities in Afghanistan than in Iraq; 32% said more U.S. troops were killed in Iraq.

The poll was conducted Jan. 19, prior to the election of Massachusetts Senator-to-be Scott Brown.

Benedict Arnold fake conservatives stab supporters in the back, call for massive VAT tax, federal sales tax, to siphon trillions out of US economy to pay off foreign bankers. The national debt is an illegitimate debt American’s are not entitled to pay, the Federal Reserve bank is a privately run cartel which hijacked America in 1913 and has been looting us ever since. Kennedy ordered the fed to be abolished and a single coin to be minted to pay back all the debt in one swoop, he was murdered a month later. We owe the bankster criminals nothing. These fake conservatives want to steal trillions through new taxes and still pose as conservatives, they are CON-servatives and now their true agenda is out for everyone to see. Shill O’Liely has also called for a socialist public option in order to have the government take over 20% of the American economy, one of the only American industries which cannot be outsourced. Top Obama czar: Infiltrate all ‘conspiracy theorists’

Friday, January 15th, 2010

In a lengthy academic paper, President Obama’s regulatory czar, Cass Sunstein, argued the U.S. government should ban “conspiracy theorizing.”

Among the beliefs Sunstein would ban is advocating that the theory of global warming is a deliberate fraud.

Sunstein also recommended the government send agents to infiltrate “extremists who supply conspiracy theories” to disrupt the efforts of the “extremists” to propagate their theories.

In a 2008 Harvard law paper, “Conspiracy Theories,” Sunstein and co-author Adrian Vermeule, a Harvard law professor, ask, “What can government do about conspiracy theories?”

“We can readily imagine a series of possible responses. (1) Government might ban conspiracy theorizing. (2) Government might impose some kind of tax, financial or otherwise, on those who disseminate such theories.”

In the 30-page paper – obtained and reviewed by WND – Sunstein argues the best government response to “conspiracy theories” is “cognitive infiltration of extremist groups.”

Continued Sunstein: “We suggest a distinctive tactic for breaking up the hard core of extremists who supply conspiracy theories: cognitive infiltration of extremist groups, whereby government agents or their allies (acting either virtually or in real space, and either openly or anonymously) will undermine the crippled epistemology of believers by planting doubts about the theories and stylized facts that circulate within such groups, thereby introducing beneficial cognitive diversity.”

Sunstein said government agents “might enter chat rooms, online social networks, or even real-space groups and attempt to undermine percolating conspiracy theories by raising doubts about their factual premises, causal logic or implications for political action.”

Sunstein defined a conspiracy theory as “an effort to explain some event or practice by reference to the machinations of powerful people, who have also managed to conceal their role.”

Some “conspiracy theories” recommended for ban by Sunstein include:

  • “The theory of global warming is a deliberate fraud.”
  • “The view that the Central Intelligence Agency was responsible for the assassination of President John F. Kennedy.”
  • “The 1996 crash of TWA flight 800 was caused by a U.S. military missile.”
  • “The Trilateral Commission is responsible for important movements of the international economy.”
  • “That Martin Luther King Jr. was killed by federal agents.”
  • “The moon landing was staged and never actually occurred.”

Sunstein allowed that “some conspiracy theories, under our definition, have turned out to be true.”

He continued: “The Watergate hotel room used by Democratic National Committee was, in fact, bugged by Republican officials, operating at the behest of the White House. In the 1950s,the CIA did, in fact, administer LSD and related drugs under Project MKULTRA, in an effort to investigate the possibility of ‘mind control.’”

Sunstein’s paper advocating against the belief that global warming is a deliberate fraud was written before November’s climate scandal in which e-mails hacked from the Climatic Research Unit at East Anglia University in the U.K. indicate top climate researchers conspired to rig data and keep researchers with dissenting views from publishing in leading scientific journals.

Sunstein: Ban ‘right wing’ rumors

Sunstein’s paper is not the first time he has advocated banning the free flow of information.

WND reported that in a recently released book, “On Rumors,” Sunstein argued websites should be obliged to remove “false rumors” while libel laws should be altered to make it easier to sue for spreading such “rumors.”

In the 2009 book, Sunstein cited as a primary example of “absurd” and “hateful” remarks, reports by “right-wing websites” alleging an association between President Obama and Weatherman terrorist William Ayers.

He also singled out radio talker Sean Hannity for “attacking” Obama regarding the president’s “alleged associations.”

Ayers became a name in the 2008 presidential campaign when it was disclosed he worked closely with Obama for years. Obama also was said to have launched his political career at a 1995 fundraiser in Ayers’ apartment.

‘New Deal Fairness Doctrine’

WND also previously reported Sunstein drew up a “First Amendment New Deal” – a new “Fairness Doctrine” that would include the establishment of a panel of “nonpartisan experts” to ensure “diversity of view” on the airwaves.

Sunstein compared the need for the government to regulate broadcasting to the moral obligation the U.S. had to impose new rules that outlawed segregation.

Sunstein’s radical proposal, set forth in his 1993 book “The Partial Constitution,” received no news media attention and scant scrutiny until the WND report.

In the book, Sunstein outwardly favors and promotes the “Fairness Doctrine,” the abolished FCC policy that required holders of broadcast licenses to present controversial issues of public importance in a manner the government deemed “equitable and balanced.”

Sunstein introduces what he terms his “First Amendment New Deal” to regulate broadcasting in the U.S.

His proposal, which focuses largely on television, includes a government requirement that “purely commercial stations provide financial subsidies to public television or to commercial stations that agree to provide less profitable but high-quality programming.”

Sunstein wrote it is “worthwhile to consider more dramatic approaches as well.”

He proposes “compulsory public-affairs programming, right of reply, content review by nonpartisan experts or guidelines to encourage attention to public issues and diversity of view.”

The Obama czar argues his regulation proposals for broadcasting are actually presented within the spirit of the Constitution.

“It seems quite possible that a law that contained regulatory remedies would promote rather than undermine the ‘freedom of speech,’” he writes.

Writes Sunstein: “The idea that government should be neutral among all forms of speech seems right in the abstract, but as frequently applied it is no more plausible than the idea that it should be neutral between the associational interests of blacks and those of whites under conditions of segregation.”

Sunstein contends the landmark case that brought about the Fairness Doctrine, Red Lion Broadcasting Co. v. Federal Communications Commission, “stresses not the autonomy of broadcasters (made possible only by current ownership rights), but instead the need to promote democratic self-government by ensuring that people are presented with a broad range of views about public issues.”

He continues: “In a market system, this goal may be compromised. It is hardly clear that ‘the freedom of speech’ is promoted by a regime in which people are permitted to speak only if other people are willing to pay enough to allow them to be heard.”

In his book, Sunstein slams the U.S. courts’ unwillingness to “require something like a Fairness Doctrine” to be a result of “the judiciary’s lack of democratic pedigree, lack of fact-finding powers and limited remedial authority.”

He clarifies he is not arguing the government should be free to regulate broadcasting however it chooses.

“Regulation designed to eliminate a particular viewpoint would of course be out of bounds. All viewpoint discrimination would be banned,” Sunstein writes.

But, he says, “at the very least, regulative ‘fairness doctrines’ would raise no real doubts” constitutionally.
